Legal Documents Every College-Age Student Needs

As a parent, you lose the ability to make decisions on your child’s behalf when he or she turns 18. You no longer have the right to make medical decisions or speak with their doctors. If you would still like to have the ability to speak to your child’s doctor and make decisions, it is important for your child to complete an advance health care directive, a HIPAA authorization and a durable power of attorney for finances.

Advance Health Care Directive
An Advance Health Care Directive allows you to make medical decisions on your child’s behalf if your child became incapacitated and unable to make medical decisions for him or herself.

HIPAA Disclosure Authorization
The Health Insurance Portability and Accountability Act of 1996 – HIPAA — is a federal law that prohibits release of sensitive patient information. The HIPAA Disclosure Authorization allows your child’s doctor to disclose their medical information to you.

Durable Power of Attorney for Finances
If you are named the agent on your child’s Power of Attorney, you would be allowed to manage bank accounts, sign tax returns, etc., if your child became incapacitated. Without this, you would be unable to do this without a court-ordered conservatorship.
